     Raipur, November 27, 2025: Chhattisgarh government has initiated action against residential societies of real estate projects registering under the wrong Act and then violating the applicable law by charging maintenance and other fees, official said today.

    The Registrar of Firms and Societies of Chhattisgarh, has for this reason, cancelled the registration of Anand Vihar Residents Development Society in Raipur and issued notices to 360 residential societies registered under the wrong category.

     The state government has clarified that this action has been taken because these societies are registered under an Act that does not provide for the collection of daily maintenance fees for colonies, even though they were regularly performing such duties.

     Residential societies are required to be registered under the Chhattisgarh Cooperative 1960 Act, it advised.

     According to the Real Estate (Regulation and Development) Act 2016, it is mandatory for any real estate project to form an allottees’ association or cooperative society within three months of more than 50 per cent of allottees booking a house or plot. These societies are responsible for the maintenance and management of the colony.

     According to the Registrar’s Office, the registration of such societies under the Chhattisgarh Societies Registration Act, 1973, as amended in 1998, is only for institutions with social, educational, and cultural purposes, as defined in Section 2 of the Societies Act. It does not contain provisions related to daily upkeep or maintenance.

     They stated that therefore, residential societies in real estate projects should be registered under the Chhattisgarh Cooperative Act, 1960. In violation of these rules, the Anand Vihar Residents Development Society was found to be carrying out maintenance work and collecting fees, which was contrary to its registered purposes. After the complaint and hearing, its registration was cancelled under Section 34 of the Act.

     Chhattisgarh Registrar of Firms and Societies Padmini Bhoi Sahu has directed a total of 360 such societies in the state that if their objectives are contrary to Section 2 of the Act, they should submit amendment proposals on the online portal rfas.cg.nic.in within 15 days.

     If the amendments are not made within the stipulated time or if a complaint is received, action will be taken to cancel the registration, she said.
